Terms & Conditions

This website provides information about Artytude. By using any of the on-line or off-line services offered by Artytude (“Services”), including accessing, viewing, entering data on or transacting on the Artytude website(s), you agree to all of the terms given below.

The information and materials contained in this site, including text, graphics, links or other items, are provided “as is,” “as available.” Artytude does not warrant the accuracy, adequacy or completeness of this information and material and expressly disclaims liability for errors or omissions in this information and material. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third-party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials. Materials copyrighted by Artytude or owned by any individual or entity are presented here for personal use only. Documents, content or images contained in this site may not be copied or reproduced in any form without the written permission of Artytude. Hyperlinks to other internet resources are at your own risk; the content, accuracy, opinions expressed and other links provided by these resources are not investigated, verified, monitored or endorsed by Artytude.

Services

Services offered by Artytude include, but are not limited to, provision of information and/or opinions, workshops, exhibitions, performances, training programs, sale of artwork, sale of products, sale of décor items, sale of fashion accessories and other such. Any or all of the Artytude Services may be offered by us on-line or off-line or in any combination thereof. Artytude may introduce a new Service or discontinue any Service or part thereof, at any time, without notice, at its sole discretion.

Limitation Of Liability

In no event will Artytude be liable for any damages, including, without limitation, direct or indirect, special, incidental or consequential damages, losses or expenses arising in connection with the use of any Services or any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Artytude, or representatives thereof, are advised of the possibility of such damages, losses or expenses. In any case, the aggregate liability of Artytude, whether in contract, damages or any other whatsoever will never exceed the fees earned, if any, by Artytude for the Services used by you.

Artists / Art Owners / Sellers / Trainers

1. You can send to Artytude for display on the website or at any event only art that has been created and/or is owned by you. By sending artwork to Artytude you certify that you are the rightful owner of the artwork and you have not infringed on anyone else’s copyright.
2. Artytude may at any time require an authenticity certificate to be signed by the artist and sent to Artytude and/or buyer along with each artwork, and you undertake to do so.
3. By offering artwork for sale/ services on the Artytude website/event, you authorize Artytude to retain a pre-decided part of the net sale proceeds/ fees, to cover expenses in offering its services, including the costs of managing the payment gateway.
4. Artytude also takes responsibility for adequate packing and suitable shipping method so that the artwork and/ or goods arrive at the buyer’s designated address in good condition, in reasonable time.
5. The artworks sent to us for display on the Artytude website or at anyevent remain the property of the artist/guardian/owner and Artytude claims no ownership of the same, unless there is a specific agreement transferring the ownership to Artytude.
6. By sending artwork to Artytude you give irrevocable permission to Artytude to share your art for all publicity and social media purposes on a worldwide basis.

Buyers

As part of its services, Artytude provides a platform for display and/or sale of various forms of artwork and products carrying such artwork.

Guarantee: Artytude provides you with art created from the heart. We love what we do and we do it to provide a platform for our specially abled and artistically inclined young adults in finding a means of livelihood through the field of arts. Artytude accepts each artwork only after receiving assurance from the party submitting it that it is original, owned by the party and unique or part of a limited series. We DO provide a certificate of authenticity from the artist/seller guaranteeing the originality and/or uniqueness of each artwork sold. We DO NOT take any responsibility for guaranteeing the originality and/or uniqueness of any of the artworks.

Payment: In order to pay for any Service, you are required to provide valid payment information as needed by Artytude/payment gateway. Artytude may terminate your request for art if we are unable to process your payment. You are also responsible, in addition, for payment of all shipping charges for sending the artwork to your designated address. These shipping charges will be included in your shopping carts, and are approximate. In case of any major discrepancy, Artytude will contact you to seek approval of additional shipping cost or, at your discretion, cancellation of the order for full refund.

Refund or Cancellation: Once any service/ product or artwork has been ordered, Artytude does not permit any cancellation or make any refund. The only exceptions to this policy are (a) if the shipping charges are significantly larger than mentioned in your cart when you ordered and Artytude asks you to pay an additional amount – at that stage you may refuse to pay any additional amount and instead opt for a full refund, which Artytude will provide; and (b) if any ongoing workshop or other event for which you have paid is partly or fully cancelled, Artytude will provide a proportionate refund. In every case, the amount of refund due will be decided at the sole discretion of Artytude. 

Shipping and Delivery: Artworks sold through Artytude will usually be shipped to the buyer, directly by the seller. On occasion, it may also be shipped through Artytude. In either case, shipment will be done after the respective event is concluded. Whether shipped by seller or by Artytude, the respective party takes responsibility for adequate packing and suitable shipping method so that the artwork arrives at the buyer’s designated address in good condition, in reasonable time.

International Users

Artytude is located in India. Even if you access the services from a country other than India, you agree that your transactions with Artytude occur in India and you are responsible for compliance with all applicable laws, rules and regulations applicable to your use of the services.
